  • Question: Due to the precise temperature control of a tankless water heater with ASSE 1082 compliance, does the code now allow compliant and tested tankless heaters to be used as tempering devices without an additional 1017 mixing valve ?

No, not at this time. Neither the current 6th Edition nor the upcoming 7th Edition of the Florida Building Code references ASSE 1082.

Commentary:

The ASSE 1082-2018 standard – Performance Requirements for Water Heaters used as Temperature Limiting Devices, is one of three new water heater standards (along with ASSE 1082 and ASSE 1085) that regulate the outlet temperature of the water heater. The recently published 2021 International Plumbing Code, which will serve as the basis of the 8th Edition of the FBC-Plumbing, does recognize this new standard and will permit water heaters complying with this standard to serve as a means of limiting water temperature in lieu of an ASSE 1017 thermostatic mixing valve. In the meantime, the plumbing designer can always pursue AHJ approval under Alternate Means and Methods.
