Question
Is it the intent of this section to include bed and breakfast under 10 occupants to change the occupancy classification from R-3 to R-1. under the new contemplated revisions is it the states intent to reclassify Congregant living facilities under 10 occupants to remain under the R-3 classification. under this assumption a Bed and Breakfast under 10 occupants transient should be able to meet the same criteria and not be changed from r3 - to r1. please clafify the intent

Yes. The exception for congregate living facilities is
specific and stated in the R-2 and R-3 sections of 310.1.
There is no similar exeption for R-1.
