  • Question: Is it the intent of the code to allow an existing church with classrooms that are presently used to serve religious purposes only (i.e. Sunday school, bible study, etc.) to now have the classrooms act as a school serving an occupant load of 50 children in grades ranging from K- 6th? Can the proposed use remain under a Group (A3)Assembly classification or is this now classified as a change of use under Group (E) Educational classification?

Yes, when the change of use is done for the
reclassification to educational.

Commentary:

Consider it a dual use, and meet the most restrictive requirements. In this case it will be the educational. If the classrooms are being used for educational purposes through the 12th grade by six or more people for four or more hours per day or 12 or more hours per week than it becomes an educational occupancy and this is a change of use.
