Question
When construction documents submitted for a single-family dwelling depict one dwelling unit with one common kitchen and no permanent provisions for cooking within individual bedrooms, may the building be required to have a different occupancy classification based solely upon a possible future use or occupancy that is not depicted in the submitted construction documents?
Answer Published 09/03/2026 at 1:56 PM
The use needs to comply with the issued certificate of occupancy (CO) as shown on the approved construction documents and permit. If there are changes to the use, a new permit for a new CO must be requested per the locally adopted chapter 1 requirements and the new use must comply with the applicable code provisions for a change occupancy.
