Question
Is mechanical exhaust required in the kitchens of dwelling units, that are in Condominium and Apartment Buildings that are taller then 3 stories in height?

Mechanical exhaust is required, however, when reading footnote b the phrase "and the recirculation of air from such spaces is prohibited" could confuse the issue. Conained in the 2017 update is the allowance for "Recirculation of air that is contained completely within such space shall not be prohibited....." So in this instance, the apartment area is the space, including the kitchen area. Therefore, a recirculation hood could be installed.
ICC Commentary, as confusing as it seems, does not discuss apartments, but multiple unit bldgs. As long as the air being recirculated is being maintained in the space that is served by that unit, it is allowed.
