Question
Is it the intent of section 310.5 of the FBC-Building to classify a dwelling unit built under the scope of the Residential Building Code as an R-3 occupancy?

Commentary
An occupancy constructed as an one-and two-family dwelling under the FBC - Residential and receiving a CO as such is not an R-3 occupancy under the FBC - Building. These are two different occupancy types with different applicable code provisions. There are uses permitted under an R-3 that are not permitted under an FBC-Residential one-and two-family dwelling. This Committee has previously ruled that a change from an FBC-Residential one-and two-family dwelling to an FBC-Building R-3 requires a changes of occupancy and a new CO.
