Question

Is it the intent of Section 403.1 of the Existing Building Code to require bringing all existing features of a building into compliance with the Accessibility Code in order to affect a change of occupancy?

More information is required for an exact answer. Items such as the size of unit, is it sprinkelerd, what is the existing and new occupancies and hazards, tenant separation and so on. Probably, yes, it needs a full upgrade to all accessible requirements.

Commentary

The accessibility code also has its own scoping for existing buildings at 202. If this is a change of use, 202.4 applies. 202.4.1 provides prioritization of upgrades with an accessible entrance being the first. The others to follow up, to 20% of the contract for the changes.
