Interpretation #7678

The intent is to locally, under very specific circumstances, allow the owner of a single family residence one or more exemptions from the prescriptive requirements of the Florida Building Code in scenario 1a, 1b, or 1c. Not to exempt the Florida Building Code entirely, otherwise, "one or more" would not exist. Item 3. under 102.2.5 states "3. Each code exemption, as defined in sub-subparagraphs 1a, 1b, and 1c shall be certified to the local board 10 days prior to implementation and shall only be effective in the territorial jurisdiction of the enforcement district or local enforcement agency implementing it." Consequently, if we cannot exempt the Florida Building Code entirely then we cannot possibly eliminate permitting where a permit is required.
