Question

Is it the intent of the exception listed in section 604.1 to allow replacing windows with the same size and type but not to have to meet the minimum Width / Height and square footage of egress as long as the clear opening of the current fenestration being replaced is not changed by more than 5%?

Yes, provided the existing openings meet the emergency
escape and rescue opening provisions in effect at the time
of original construction.

Commentary

The existing openings may be reduced by 5%. This was the subject of Declaratory Statement DCA07-DEC065. The Code Editions and Section references have changed, but the code provisions remain the same.
