Is it the intent of the code that a bathroom window that meets the emergency escape sizes with a bath tub under it be used as a emergency escape window.

No, the bathroom window may not serve as the emergency
escape and rescue opening. The referenced section
indicates the emergency escape and rescue opening must be
located in the sleeping room not a different room or

Making ones way to the bathroom and negotiating entry
through shower curtains or enclosures and into the bathtub,
which may provide questionable footing; in order to access
the emergency escape opening would be inconsistent with the
intent of the referenced section. Additionally, the opening
is also for rescue. Firefighters making entry into a
bathroom instead of the sleeping room could complicate or
compromise their rescue efforts.
