Question
Is it the intent of section 102.8 of the 2010 Florida Building Code to require an equal change out of a roof top mechanical unit to comply with section 1509.7?

Yes, the replacement of mechanical
equipment on an existing roof would
need to comply with the requirements of
FBC-B 1509.7. Section 102.8 was added
to the code as a result of legislation
to prevent AHJs from requiring units be
installed on stands where the equipment
otherwise would not have been removed
or replaced as a function of a re-roof
or other work. However, if the
equipment is located on the roof and
must be removed or replaced, then
section 102.8 would imply the AHJ may
require the new unit to be installed in
compliance with the appropriate code
sections.

Commentary
Most would agree that
equipment replacement would constitute
a Level 1 Alteration. Section 602.4
requires all "New Work" to comply with
the requirements of the FBC-Building,
Mechanical, Energy and Plumbing. Thus
the link from The FBC-Existing to FBC-B
Section 1509.7. If the re-roofing can
be done without removing or replacing
the rooftop equipment, then applying
1509.7 would be inappropriate.
However, once the equipment is
disconnected from the electrical,
refrigeration and/or duct, then it
would need to be installed on a stand
and appropriately anchored to meet the
wind resistance.
