Question

Is it the intent of FBC-Mechanical section 301.12 (& M1301.1 ) to be in conflict with Florida Statute 553.844(4) were it says 'further support or enclosure of such mechanical equipment or appliances is not required by a state or local official having authority to enforce the FBC'?

Yes.

Commentary

Please note: FS 553.844(4) was designed to postpone implementation of 301.12 of the FBC-M. It expires upon implementation of the 2010 Florida Building Code. In all cases the equipment is still required to be anchored to meet the wind loads, but the specific wording that requires the equipment itself to be designed to withstand the windloads was exempted by this Statute.
