Question
Is it the intent of the Plumbing Code sec. 403.2, exception 2, to require separate toilet facilities for seating in excess of 10 even though the occupancy is considered a Mercantile occupancy?

Yes.
Commentary
While exception 3 would apply per the Building Code,
exception 2 would also apply, meaning only for up to 10
seats. Over 10 seats you still need to provide seperate
toilet rooms. DCA has ruled on similar interpretations and
when 2 code sections conflict you must go by the most
stringent requirement. In this case exception 2, seperate
toilet rooms.
