Question
Is it the intent of Section 903.6 to require the installation of an automated fire sprinkler system in a three-story mixed use building when the second and third stories are occupied by a single dwelling unit with no additional dwelling units located at any level of the structure, and no such sprinkler system is required by any other section of the Code?

Yes.
Commentary
903.6.1 requires sprinklers in all three-story buildings,
and lists exceptions to the requirements. The property
described does not meet any of the exceptions.
Since it is a mixed use, this building could not be
constructed in accordance with the FBC-Residential so the
building must be fire sprinkler protected regardless of
stories.
