Question
Is it the intent of Florida Building Code - Residential Section R4101.6.1 and the reference to ANSI/NSPI-3 Residential Spa Standard to cover ALL seats/sitting bench at a maximum water depth of 28" and not just only "Muti-level seating"? In a residential spa, what is the maximum water depth to the single depth seat/sitting bench?

Yes. Although the provision is found in Florida Building
Code - Residential Section R4101.6.1, Multi-Level Seating,
the provision does not apply solely to multi-level seating,
but establishes the maximum depth of any seat.

Commentary
From NSI-NSPI- 3-1999: "5.3 Multi-Level Seating: Multi-level
seating may be provided, but the maximum water depth of ANY
seat or sitting bench shall be twenty-eight inches (28")
[71.12 cm] measured from the waterline."
