Existing Interpretations and/or Declaratory Statements Related to this request

Is it the intent of 706.1.1 to require party walls in all cases, including residential multi-family dwellings (duplexes) in which the demising wall between the dwelling units is located on the property line of two separate parcels. In which case a 2 hour fire wall is required per table 706.4 Thank you

Input Received:

The Exception in 706.1.1 contains the following : If an existing roofing system or roof section was built, repaired, or replaced in compliance with the requirements of the 2007 Florida Building Code, or any subsequent editions of the Florida Building Code, and 25 percent or more of such roofing system or roof section is being repaired, replaced, or recovered, only the repaired, replaced, or recovered portion is required to be constructed in accordance with the Florida Building Code in effect, as applicable.
The section that states: only the repaired, replaced, or recovered portion is required to be constructed in accordance with the Florida Building Code
The code does not contain a definition for the word portion.

CHAPTER 2 DEFINITIONS
201.4 Terms not defined.
Where terms are not defined through the methods authorized by this chapter, such terms shall have ordinarily accepted meanings such as the context implies.
portion is a part of any whole, either separated from or integrated with it:
ROOF SECTION is defined in the code an applies to the section being discussed as: A separating or division of a roof area by existing expansion joints, parapet walls, flashing (excluding valley), difference of elevation (excluding hips and ridges), roof type or legal description; not including the roof area required for a proper tie-off with an existing system.
Therefore, a portion would only include the repaired, replaced, or recovered portion not including the roof area required for a proper tie-off with an existing system.
I don't think I can add much to this.
A building can have multiple roof sections; others may only have one or two. I have treated each roof plane as that's roof section.

Answer:

A building can have multiple roof sections; others may only have one or two. Typically, each roof plane is treated as that's roof portion, or section. Also refer to Chapter 2 for the definition of a roof section.

Commentary:

None.

Comments on Draft:

This interpretation should include a reference to the definition of roof section found in chapter 2.
