  • Question: Is Fire-Resistant Construction required for my application? Please review the three PDF that I have attached. This project relates to a "lean to" type structure
  • Comment: 1. I do not have a wall, a wall is a solid material that does not allow wind to pass through, correct? There is no wall, this is an open roof structure that is supported on one end by post and the other by the existing “wall” of the house. 2. My comments for item 7. For zero lot line developments where permitted by local regulations (Yes I have an approved variance for this, correct, Yes I do so this means I can build up to the property line, it does not mean that my house is now a Zero line development property please see November 5, 2020 Letter P20 184)184), openings and roof overhang projections shall be permitted on the exterior wall of a building located on a zero lot line when the building exterior wall is separated from an adjacent building exterior wall by a distance of 6 feet or more (my neighbor’s house is 10 feet away so this requirement is met, check number 1) and the roof overhang projection is separated from an adjacent building projection by a distance of 4 feet or more (my neighbor’s house is 10 feet away so this requirement is meet, check number 2) 2), with 1 hour fire resistive construction on the underside of the overhang required, unless the separation between projections is 6 feet or more (my neighbor’s house is 10 feet away so this requirement of needing a fire resistive construction on the underside is not required, check number 3)." 3. Therefore since I have met all the requirements for an exceptions per item 7 as explained above and that I have a variance approval ( P20 184 --"to allow a 0 foot side yard setback") for building up to the property line. The requirement that my posts be 2 or 3 feet from the property line is not even relevant to this topic.

Exception 7 does not apply. This is just a residential property with a zoning variance to build to the property line. The adjacent neighbor might be granted the same variance. It is admitted it is not a zero lot line development. The the wall supporting the shed roof on one end is not on the zero-lot line. It is not a roof overhang projection as it is supported by posts at the property line. It must be built to the standards of R302.1 with the other exceptions that may be applicable.

It is important to note the Residential volume of the building code, while not addressing setbacks, that is a Zoning issue, does address fire separation distance. Exception 7 applies specifically to zero lot line development. It is admitted this is not a zero lot line development. This appears to be a residential property with a zoning variance to build to the property line. The adjacent neighbor could apply for the same or a similar variance. The wall supporting the shed roof on the far end is not on the zero-lot line. It is not a roof overhang projection as it is supported by posts at the property line. As such, it must be built to the standards of R302.1 with the possibility of using any of the other exceptions that may be applicable. For the general rule, according to table 302.1, a minimum 1 hour fire resistance rating with a 2 foot dimension to the property line appears to be the minimum.
