  • Question: Plumbing code Section has an exception for public toilet where quick transactions, including takeout, pickup and drop-off, having a public access area less than or equal to 300 square feet. FBC-Bldg Section 456.4.1.1. states "Places serving food or drink on a take-out, carry-out or delivery basis only which provide no seating shall be required to provide a minimum of one bathroom accessible to the public." Since 456 is based on State Statute would this section over ride what is in the plumbing code?

The answer is yes to the question. The specific, more restrictive requirements of FBC, Building 456 take precedent over the general requirements of FBC, Plumbing 403.3. See FBC, Building section 102, Where there is a conflict between a general requirement and a specific requirement, the specific requirement shall be applicable. Where, in any specific case, different sections of this code specify different materials, methods of construction or other requirements, the most restrictive shall govern.
